In UGC you sell two things at once: a video, which is a work, and your image, which is your personal data. A contract that only talks about the video leaves half the deal unwritten, and that half is usually the one that ends in an argument.

The five clauses that decide everything

1. What is transferred

The finished video, the raw files, the photos, or all of it. If it is not stated, each side assumes something different.

2. Where it may be used

The brand's channels, paid media, website, point of sale, catalogue, email, television. Each channel is a different use and carries a different price.

3. For how long

Ninety days, six months, a year. Perpetual transfer exists, but it is priced for what it is: forever.

4. In which territory

Spain, Europe, worldwide. A brand that exports will use your face in markets you never imagined.

5. What happens to your image

Your consent to appear is revocable in data protection terms, and that deserves to be regulated: what happens if you ask for the content to be withdrawn, and within what timeframe.

What to add every time

Exclusivity: if the brand asks you not to work with competitors, that is an additional service, with a duration, a list of brands and a price.

Whitelisting: if the ad runs from your account, that is another product. Never hand over access without a term, a budget cap and a specific fee.

Modifications: if the brand may cut, dub or subtitle your video, say so. And expressly prohibit use for training automated systems if you have not agreed to it.

Payment: amount, date, method and what happens if it is late.

The Spanish detail

You work as a registered self employed professional, so the contract is between professionals, not an employment contract. That gives you freedom and also responsibility: nobody will protect you if you accepted a worldwide perpetual transfer for 150 euros.

If the client is an agency, ask which end brand it is for. A transfer signed with an agency that later sublicenses to its client must say so in writing.

A one page contract is enough

You do not need twenty pages. You need the five clauses above written clearly, signed by email if necessary. A short, clear agreement protects you more than a long document nobody has read.
