Almost every problem between brands and creators in Spain starts at the same point: the video was delivered, but nobody wrote down what may be done with it. Five lines agreed before filming avoid most of the arguments.

The five points to put in writing

Channels

Organic on the creator's profiles, organic on yours, paid ads: three distinct levels, three distinct prices.

Duration

Three, six or twelve months. If you want indefinite use, it is paid for as such.

Territory

Spain, Europe, Latin America, worldwide. In Spanish this point matters more than in other languages, because the same video works across many countries.

Editing

Whether you may recut, add subtitles, use extracts, change the music.

Image consent

Face and voice are a personal right, separate from the video, and they need covering with the same limits.

What changes when the content becomes advertising

Sponsored content the creator publishes on their profile has to be identified as advertising. When the video runs as an ad from your account, the obligation is yours as the advertiser. The problem appears when a brand takes an undisclosed post and turns it into an ad: both sides end up exposed.

The two costliest mistakes

Using the video after the licence expires. It usually surfaces when somebody points it out, and by then it is no longer a negotiation.

Buying without explicit image consent. The file is yours by contract, the person's face is not.

What is enough

A two page document: the service, the five points, price, timings, revisions. If the creator already has one, better still: it means they have worked with serious brands.
