What you sell is not a file, it is a licence. In Italy that distinction is still unclear to many clients, and that is exactly why it has to be written into the order.

The four licence questions

Licence pointWhat it covers
1. What useOrganic only, or also paid advertising.
2. What durationSix months, twelve months, unlimited. Twelve is the standard.
3. What territoryItaly, Europe, worldwide.
4. Exclusive or notCan you shoot for a competitor during the period?

On top of those comes whitelisting, running the ad from your own account: a further right, priced separately.

Image rights

Separate from the content licence, and about you. If you appear in the video, you authorise the use of your image for a defined duration and on defined media. That is not a formality: a video still running in ads three years later, when you never granted that duration, is your problem, not the client's.

Write it explicitly, with the same duration as the licence.

The five lines that prevent disputes

Deliverable: 1 video 30s, 9:16, MP4, captions included
Price: [amount], balance on approved delivery
Revisions: 1 included, [amount] per additional revision
Licence: organic + Meta and TikTok ads, 12 months, Italy, non exclusive
Image: use of likeness authorised for the same duration and the same media

Five lines accepted in writing are worth more than a ten page contract nobody reads.
