What a brand buys from you is not the file. It is permission to use it. In Germany that point is treated more seriously in contracts than in many markets, and that is exactly why a clear agreement protects both sides.

Two rights that get negotiated together

Usage rights in the video. You created it, you grant the client a right of use: for specific channels, for a specific duration, in a specific territory.

Personality rights in your image. Your face and your voice are a second point. If you appear in the video, you consent to its use, and that consent should follow the same limits as the usage rights.

The five lines that prevent disputes

  1. Channels: organic on the brand's own profiles, or paid ads too, or website and newsletter as well.
  2. Duration: three months, six months, twelve months. Perpetual is expensive and should be priced that way.
  3. Territory: Germany only, the German speaking region, or worldwide.
  4. Editing: may the brand recut, revoice or use extracts.
  5. Transfer: may the brand pass the material to retailers, marketplaces or partners.

Buyout does not automatically mean everything

"Buyout" is a word from practice, not a legal magic spell. If a client wants a buyout, ask what exactly it should include, and price it. An unlimited worldwide buyout is worth a multiple of the video price, not a ten percent uplift.

Data protection and disclosure

Paid content is labelled in Germany when it runs on your own channels. When your videos run as the brand's ads, disclosure sits with the advertiser. For specific cases a short legal check is worth it, especially for health or financial products.
